These Terms and Conditions (“Terms”) govern all services provided by Agency Allies (“Agency Allies,” “we,” “us,” or “our”) to clients and candidates. By engaging our services or accessing our website www.agencyallies.nl, you agree to these Terms.

1. Services

Agency Allies connects creative and digital agencies with highly skilled professionals. We provide recruitment, matchmaking, and related advisory services. Unless otherwise agreed in writing, our services do not include payroll, employment, or legal representation.

2. No Employment Relationship

Agency Allies acts solely as an intermediary. We do not employ candidates on behalf of clients, and no employment contract exists between Agency Allies and any candidate introduced.

3. Client Responsibilities

• Clients are responsible for:

  • Assessing candidate suitability.

  • Complying with all employment laws, including work permits and contracts.

  • Promptly informing us when an introduced candidate is hired.

• Clients shall not share candidate profiles with third parties without prior written consent.

4. Candidate Responsibilities

Candidates agree to provide accurate, truthful, and complete information. Agency Allies is not responsible for inaccuracies or omissions in candidate-provided information.

5. Fees and Payment

• Placement fees and payment terms will be specified in a separate proposal or agreement.

• Fees are due within [30] days of the invoice date, unless otherwise agreed in writing.

• Late payments may incur interest at the statutory commercial rate.

6. Confidentiality

All information exchanged between Agency Allies, clients, and candidates shall be treated as confidential and used solely for recruitment purposes.

7. Liability

• Agency Allies is not liable for any direct or indirect damages, losses, or costs arising from the recruitment process, including but not limited to:

  • Candidate performance or conduct.

  • Decisions made by clients based on introductions.

• Our total liability is limited to the amount of fees paid to us for the specific assignment.

8. Data Protection

We process personal data in accordance with applicable data protection laws and our Privacy Policy.

9. Intellectual Property

All materials, content, and data provided by Agency Allies remain our property unless explicitly transferred in writing.

10. Termination

Either party may terminate the relationship with written notice, subject to any specific provisions in an agreed service contract.

11. Governing Law and Jurisdiction

These Terms are governed by Dutch law. Any disputes arising from these Terms will be submitted exclusively to the competent court in Amsterdam, the Netherlands.

12. Changes to Terms

Agency Allies reserves the right to update or modify these Terms at any time. The most current version will be available on our website.
